By adding a listing on Torch-Biz, you are representing that you have the authority of the relevant business to do so. That representation, as well as the accuracy of the content you supply to Torch-biz, is governed by our Terms of Use which include information about some uses of your data in the Privacy Policy. By clicking on the submit button, you are confirming that you have read our terms, understand them and are happy to be bound by them.

The Torch-biz Terms of Use available at http://www.torch-biz.co.uk/TermsOfUse.aspx These terms of use apply when you post content, such as a business listing, on http://www.torch-biz.co.uk/TermsOfUse.aspx ("Site").

The Site is owned and operated by Torch-Biz ("we", "our" or "us").

You may not post content on the Site if you do not accept these Terms.

You can accept the Terms by either clicking that you agree or accept these Terms (where available) or posting content on the Site. If this is the case, we will treat your posting of content as your acceptance of the Terms.

You can post content on the Site containing general information about your business, including a description of your business, contact and website details, your press releases and product and service key words ("Content").

You can update, delete or modify content you have posted on the site. To do this you must first log in using the email address and password you submitted when creating your initial listing. If you did not originally post the content on the site you can also update/remove the content once your association with the company has been verified and a password has been supplied. To do this, simply enter the email address into the 'lost password' section and details will be sent to the email address shortly after.

We may publish and communicate to the public any content you submit to us through the Site. You grant us a perpetual, royalty-free, non-exclusive, irrevocable worldwide licence to:
• reproduce, modify, add to, use, copy, publish, communicate and adapt the content for any purpose and in any manner anywhere in the world;
• permit any person to assist us to do the things referred to in the above;
• sublicense any of the rights referred to in the above to any person ("Licence").

You acknowledge and agree that:
• the Licence includes a right for us to make the content available to other companies, organisations or individuals with whom we have a relationship for the provision of services and to use such Content in the provision of those services;
• Users are able to post comments and ratings on your business or service and Torch-biz cannot be help responsible for the content of any comments posted by users • we will allow users of the site to search content you have posted.
We may, at our sole discretion, modify or remove any content at any time. We may also terminate your account if you have breached, or we consider that you will breach, these Terms.
• We may publish any comments posted by the public in regards to the products and services you offer. You may however request for the comment to be removed should it breach your rights, but this could result in the removal of your listing

The Licence will survive any termination of these Terms.

• post Content for a business not located in the UK;
• upload, post, transmit or otherwise make available any content that you do not have a right to make available under any law (including any regulation, rule or code) or under contractual or other legal relationships, including any self regulatory codes (for example, the advertising code of practice);
• publish false or misleading Content;
• post any inappropriate, profane, defamatory, abusive, threatening, obscene, indecent or unlawful Content;
• infringe the intellectual property rights of others;
• breach a law that restricts advertising of a profession;
• violate, or cause us to violate, any applicable law, regulation, standard or code.

You: • must be at least 18 years of age to post Content;
• are solely responsible for Content you post on the Site, and must maintain and keep the Content current;
• acknowledge and agree that you are solely responsible for your breach of these Terms and the consequences of such breach, including loss or damage suffered by us or a third party;
• must ensure that when you provide us with information, this information is accurate and correct;
• must have the authority or have the permission of the relevant business owner to post the Content and grant us the Licence;
• must ensure that any Content is in English;
• must only post Content containing the contact details of, or about the products and/or services offered by, the business you wish to list on the Site;
• consent to receiving commercial emails sent by us;
• will cooperate with any reasonable request we make to verify the accuracy of Content you have posted.

To the maximum extent permitted by law, we exclude all: • warranties relating to the Site and your use of the Site;
• liability for any damages or loss however caused (including, without limitation, financial loss and indirect or consequential losses) arising in contract, tort (including negligence), statute or otherwise suffered by you as a result of submitting Content.
Where any law implies a warranty into these Terms which may not lawfully be excluded, then to the maximum extent permitted by law, our liability for breach of such warranty will, at our option, be limited to the supply of the services again, or paying the cost of having them supplied again.
You indemnify us, our officers, employees and agents in relation to any losses, claims, demands, damages, costs (including legal expenses on a full indemnity basis) and penalties in relation to your breach of these Terms or any negligent or wilful act or omission by your or your representatives.

We will use any personal information we collect, use or disclose in accordance with these Terms and our Privacy Policy available at http://www.Torch-biz.co.uk/Privacy.aspx.
You consent, and must procure any third party consents, to our use of that personal information for publication on the Site.

We may vary these Terms at any time. If so, we will post a notice on the Torch-biz home page stating that there has been a change.

Payment is taken via the secure payment gateway 'Paypal' and so your credit/debit card information is safe as it is never revealed to anyone at Torch-Biz. If you choose a monthly payment option, you will be required to set up a recurring paypal payment. Your listing will not be authorised until payment has been recieved, you email has been confirmed and your listing has been reviewed. At the same time, your listing date will not begin until the day your listing has been put live. You will never need to provide us with any bank details. Should you recieve any calls requesting information of this nature, please let us know as soon as possible and do not give out any financial information (unless it relates to a payment already made or a recurring payment order that already stands).

We will never sell any of the information that you provide as part of your listing on the Torch website. You will be provided with a password, which you will need to enter, should you need to modify any of the information previously entered. You will never recieve a sales call from 'Torch'. Should your payment fail, you will be given just 2 weeks to contact us and rectify the issue. Failure to do this may result in your listing information being removed from the database.
